These Terms of Service ("Terms") govern access to and use of SMMDude (the "Service"), operated at smmdude.com (the "Site"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By registering, you represent that you meet these requirements.
The Service allows registered users to purchase social media engagement services (such as channel or group members, views, and related services) for links and accounts they submit. Orders are fulfilled through third-party providers. The Service acts solely as an intermediary between you and those providers.
You are responsible for maintaining the confidentiality of your account credentials and API key, and for all activity that occurs under your account, whether or not authorized by you. Notify us immediately of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account or API key.
The Service operates on a prepaid wallet basis. Funds must be added to your wallet before placing an order. Prices are set at our discretion and may change at any time without notice; the price in effect at the time an order is placed applies to that order. Once an order has been submitted for fulfillment, it generally cannot be cancelled or refunded, except at our sole discretion. Wallet top-ups are reviewed manually and credited once confirmed; submitting false or fraudulent payment information is prohibited and will result in account termination.
The Service is not affiliated with, endorsed by, or sponsored by Telegram, Instagram, Meta, or any other platform referenced on the Site. Using the Service may violate the terms of service of the platform on which you use it. You are solely responsible for determining whether your use of the Service complies with the terms of any third-party platform, and for any consequences of that use, including but not limited to content removal, account suspension, or account termination by that platform. We make no guarantee regarding the quality, retention, timing, or permanence of any engagement delivered, and outcomes may vary or fail entirely due to factors outside our control, including changes made by third-party platforms or providers.

We reserve the right to refuse, cancel, or reverse any order, and to suspend or terminate any account, that we believe in good faith violates this section, with no obligation to refund amounts already spent.
API access is provided for legitimate automation of your own account activity. Your API key must not be shared or disclosed to unauthorized parties. We may rate-limit, suspend, or revoke API access at our discretion, including in response to abusive or excessive use.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation and may suspend, modify, or discontinue the Service, in whole or in part, at any time without liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATOR OF THIS SERVICE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify and hold harmless the operator of the Service, and its owners, employees, and affiliates, from any claim, demand, loss, or damages, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right, including any platform's terms of service.
We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, the Service, or third parties, or for any other reason at our discretion. Upon termination for cause, any remaining wallet balance may be forfeited.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the operator's jurisdiction of establishment, without regard to conflict-of-law principles, unless otherwise required by applicable mandatory consumer protection law.
